Abstract
When a child is born intersex, it demands a different analysis of the male-female classificatory identity pattern. This article aims to discuss the guarantee to the civil registry of the intersex child from the perspective of the right to identity. Qualitative methodology: literature review, legislative review and semi-structured interview. The trend of scientific production does not favor the right to the identity of the intersex child. It is not yet possible to identify a specific and more effective legislative path.
