Memory and transitional justice to “democratic times” – Analysis of the case of the truth commission of Ecuador from a critical perspective

Abstract

In 2007 a Truth Commission was established in Ecuador, with the release of the report in 2010. This Commission focused in particular on the serious human rights violations committed in the government of León Febres-Cordero, elected democratically from 1984 to 1988. Thus, in this case, a transitional justice mechanism was used to deal with violence committed under democratic rule, which in itself raises questions about the concept of democracy. The article points to this reflection based on Joaquín Herrera Flores' critical theory of human rights and invokes memory as an indispensable political category for the construction of democracy, making a critical reading of the Ecuadorian case.
