The public service user and the application of Law 13.460/2017 in ligth of Executive and Judicial Powers

Abstract

With the entry into force of the Code (Law 13.460 / 17) in June 2018, for the Union, States, Federal District and Municipalities with a population greater than 500 thousand inhabitants, the article was intended to verify, in addition to the changes introduced, whether - and how - this has been used in court decisions. The judgments were searched on the website of the Paraná Court of Justice, with a time lapse from the date of entry into force (June 17, 2018) until June 17, 2020. In addition, a search was carried out on the portals of the transparency of the State of Paraná and the Municipalities of Curitiba and Londrina, with the intention of verifying if aspects of the legislation had been implemented. The research methodology adopted was the hypothetical-deductive method, based on the hypothesis that the legislation was being used in the Executive and Judiciary branches. The preliminary results were that, although it has been in force for more than two years, the law is still being little used in judicial decisions and in the transparency portals.
